Overview

Pharming is seeking to hire a Senior Counsel to work cross-functionally to assist, as a business partner, in implementing Pharming's growth strategy while monitoring and managing the legal risk of the Company. Our goal is for the role to serve as the primary legal advisor to Pharming's Clinical and Medical Affairs teams and support contract drafting, review and negotiations company wide. Successful execution will involve deep knowledge of federal and state pharmaceutical and healthcare compliance laws and regulations. This is a hybrid role - must be able to report 2 to 3 days to the Warren, NJ office.

Key Responsibilities

The Senior Counsel will be responsible for a wide variety of matters in support of Pharming's growth as we increase the number of both pipeline and marketed products.

Core functions include:




  • Provide practical, solutions-oriented legal counsel to Medical Affairs and Clinical Research teams on various matters including publications of studies, medical information requests, trial design, subject recruitment, intellectual property considerations, and emerging legal risks.
  • Independently draft, review, and negotiate a variety of agreements including clinical trial agreements, licensing agreements, contract research organizations (CROs) agreements, investigator-initiated study agreements, vendor agreements, consulting agreements, and master services agreements, while ensuring alignment with business objectives.
  • Develop and refine contract templates, standardized provisions, and guidance.
  • Mentor and assist non-attorneys during contract drafting and negotiations.
  • In coordination with outside counsel and internal teams including Clinical and Medical Affairs, help establish, protect and enforce intellectual property rights, and mitigate third-party risks.
  • Serve as Legal Reviewer on Medical Review Committee, reviewing materials and participating in team meetings.
  • Stay current on evolving legal, regulatory and business issues, including enforcement actions and trends, Office of Inspector General (OIG) advisory opinions, and developing laws affecting the industry.
  • Assess and revise policies and procedures to ensure compliance.
  • Conduct training and lead presentations at company meetings.



Minimum Qualifications




  • Juris Doctorate degree from an ABA-accredited law school.
  • Member in good standing of a state bar; New Jersey preferred.
  • 7+ years of legal experience within the life science industry, including 2+ years of in-depth experience supporting clinical research.



Preferred Qualifications




  • Deep knowledge of federal and state pharmaceutical and healthcare compliance laws and regulations, including anti-corruption, anti-kickback, fraud and abuse, anti-bribery and transparency laws.
  • Familiarity with legal intellectual property considerations in clinical research and contracting.
  • Ability to effectively communicate legal requirements and identify legal or compliance related issues.
  • Experience counseling on privacy related topics and/or corporate matters, including corporate governance
  • Experience advising on rare disease clinical research.
  • Ability to work deeply and collaboratively across multiple departments
  • Commitment and alignment to Pharming's mission, core values and behaviors
  • Travel - Include 10% travel time required for the position where travel occurs locally or internationally, if applicable



Salary Range

Pharming takes into consideration a combination of candidate's work experience, training, and education, as well as the scope of the role, complexity, and external market and internal value when determining a salary level.

The base salary range for this job is from $240,000.00 TO $270,000.00 per year.
