Job Summary

Smith College seeks an experienced Civil Rights Investigator / Deputy TItle IX Coordinator to support the College's prevention of and response to discrimination, harassment and sexual misconduct. The successful candidate will join the Civil Rights Compliance team in the Office of the General Counsel.

Reporting to the Director of Civil Rights Compliance and Title IX Coordinator, the Deputy Title IX Coordinator & Civil Rights Investigator (Deputy Coordinator) is responsible for helping to ensure compliance with federal and state non-discrimination laws, including those pertaining to gender-based discrimination and sexual harassment, and compliance with the College's related policies. The Deputy Coordinator is also responsible for assisting in the assessment, investigation and adjudication of discrimination, harassment and sexual misconduct matters.

The successful candidate will have advanced interpersonal skills, and excel at working in a community that is broadly diverse with regard to age, race, ethnicity, socioeconomic status, gender and gender identity, nationality, sexual orientation, and religion. Essential Functions

Complaint Intake, Resolution and Investigation (40%)

  • Provides subject-matter expertise on the requirements of and compliance with applicable federal and state laws (Title VI, Title VII, Title IX, VAWA, Campus SaVE, ADA, Section 504 and related federal and state laws).
  • Receives and responds to complaints of discrimination, harassment and sexual misconduct.
  • Coordinates and facilitates neutral processes and support measures (e.g., connections to support resources, no-contact orders, investigations, hearings, informal resolutions).
  • Manages cases and utilizes case management systems.
  • Performs investigations and helps to ensure timely and equitable resolution of assigned reports of discrimination, harassment, sexual misconduct, domestic violence, dating violence, and stalking involving members of the College community, including writing reports.
  • Handles grievances related to the ADA and Section 504.
  • Works collaboratively and effectively with other College departments.

Training (20%)

  • Assists in developing and conducts training and workshops for campus constituents regarding discrimination, harassment and sexual misconduct prevention and response.

Compliance (25%)

  • Assists the Director of CRC with the College's civil rights compliance efforts, including the development, implementation, and monitoring of appropriate disclosures, policies, procedures and practices designed to comply with federal and state laws, regulations, and case law.
  • Supports the Director of CRC in performing continuous evaluation and assessment of policies addressing harassment, discrimination and sexual misconduct for effectiveness.
  • Assists the Director of CRC in managing a comprehensive case management system for all reports of discrimination, harassment and sexual misconduct.
  • Collaborates with the College's Campus Safety Department to ensure accuracy in reporting annual crime statistics, as required by the Jeanne Clery Act, and other reports required by state or federal law.
  • Collects, maintains and analyzes data, as appropriate to contribute to an Annual Report.
  • Develops, reviews, and revises content for the College's web page related to discrimination, harassment and sexual misconduct prevention and response.

Miscellaneous (15%)

  • Represents OCRC on Committees and at meetings, as needed.
  • Acts in the absence of the Director of CRC / Title IX Coordinator.
  • Contributes to an environment that encourages knowledge of, respect for, and development of skills to effectively and supportively engage with those of varied cultures or backgrounds.
  • Participates in self-directed professional reading, develops professional contacts with colleagues, and attends professional development courses and training to ensure a full and up-to-date understanding of the legal requirements and best practices related to compliance with applicable federal and state laws.
  • Contributes to the overall success of the College by performing other duties as assigned by the Director of CRC.

Minimum Qualifications

Education:

A Bachelor's degree is required.

Experience:

Minimum of five (5) years of experience investigating, litigating, or otherwise resolving discrimination, harassment and sexual misconduct complaints (including Title IX complaints) in a college or governmental setting. Significant investigatory experience is required. Experience in presenting educational and training programs is required. Familiarity with Titles VI, VII, IX, VAWA, Campus SaVE, ADA, Sec. 504 and related federal and state laws is required.

Skills:

Strong organizational, interpersonal, writing and speaking skills, and the ability to communicate effectively within a college environment are required. The ability to work independently and as part of a team in a time-sensitive environment is required. Demonstrated ability to develop knowledge of, respect for, and skills to effectively engage with those of varied cultures or backgrounds is required. Demonstrated ability to oversee and manage caseload in a manner that ensures the prompt, effective, and equitable conclusion of such matters is required. Demonstrated ability to maintain confidentiality, and support individuals in an empathetic manner is required. Participation in the College's efforts to create a respectful, inclusive, and welcoming work environment is required.

Keyboarding proficiency is required. Computer application skills (word processing, spreadsheet, file management, web page development and maintenance) are required. Multi-tasking abilities and the ability to meet deadlines while remaining focused and composed are required.

Preferred Qualifications

Education:

A J.D. degree or Master's Degree in a related field is preferred.

Experience:

Experience working with individuals impacted by sexual misconduct, domestic violence, and/or other types of trauma, is preferred.

Skills:

Demonstrated ability to work with individuals impacted by sexual assault, domestic violence, or other types of trauma is preferred. Experience using Maxient and/or EthicsPoint is preferred.
